Back in May rapper 50 Cent filed a defamation of character lawsuit against his youngest son's mother, Daphne Joy, after she accused him of emotional and physical abuse and r ape in a post on Instagram [click here if you missed that].
50 has had a change of heart...

The rapper just filed new legal docs, obtained by TMZ, asking the judge to dismiss the suit without prejudice ... the judge has yet to sign off, but it's just a formality at this point.
Daphne deleted the post back in July [click here if you missed that].
