Kevin Roper, the Walmart truck driver who plowed into the back of Tracy Morgan's limo bus on the New Jersey turnpike, had been awake for more than 24 hours before the crash…
According to the criminal complaint filed by the Plainsboro prosecutor Kevin Roper caused the crash "specifically by operating the aforementioned vehicle on the New Jersey Turnpike without having slept for a period in excess of 24 hours."
Comedian Tracy Morgan was critically injured in the crash and his longtime writing partner and friend James 'Uncle Jimmy Mack' McNair was pronounced dead at the scene.
Kevin Roper was charged with death by auto, assault by auto and released on $50,000 bail.
Meanwhile Tracy Morgan is listed in stable condition and his publicist has denied wide spread rumors that his leg has been amputated.

Very sad. I work graveyard shift (10pm-6:30am) and I know firsthand how sleep deprivation affects the body. It's no joke. These truck drivers are out here like zombies behind the wheel. It's no different than driving drunk.

Ok, dude was up 24 hours without sleep. And they are allowed to drive 14 hours ONLY and shut down. When your off duty its up to you to get your rest. A freight company does not give a dam if you had a restless night, turn it up, you are on your OWN time. They are covered. Majority of freight companies have a computer system that you log in and out of. Or they will shut you down. This is how they get paid. What driver will continue to keep pushing and their is no record of driving? And if they are using a manual log book. CHP just has to check the weight stations and they can pin point how long you have been driving. There is really no way around this. If you are caught driving after your 14 hours...the fines for a class A drivers are steep. That ticket will stay on your DMV record for ten years. Try getting another job with that shit on your record!
WALMART SHOULD TAKE SOME BLAME IN THIS ESPECIALLY IF HE WAS ON THE CLOCK WORKING AND THEY KNEW IT. WALMART IS KNOWN FOR WORKING THEIR EMPLOYEES LIKE SLAVES AND THEY SHOULD BE HELD ACCOUNTABLE AS WELL. You are correct my ex is a trucker who drives long distance all over the country. so this fool has no excuse I know his dumb arrogant ass too. met this fool in a Jamaican restaurant in Georgia I think he's friends with my ex as well. no company is going to hire this fool with his fucked up driving record and his reckless behavior, they also posted on his twitter account him bragging about being a road hog, talking bout the road is mine get out the way or get hit. dumb ass!!! I don't think Walmart should be punished since they clearly have rules about how long a driver can be on the road before he's required to "shut down/go to sleep"....HOWEVER... I realize this is America, a capitalist nation and public companies are held responsible. Walmart did say that when the investigation is complete and if they (driver) are held responsible then they (Walmart) will take full responsibility (pay for their employee's wrong doing).. Won't replace the life that was taken.. but well...
I read on another blog that truckers driving hours and such are tracked by computer. However, supposedly some companies coerce their drivers into falsifying hours, driving beyond the limit by law, upon threat of firing for "minor" infractions.
If this is true, it sounds as if the trucker will be forced to take the complete fall should they get caught.
Can one of the posters elaborate on this, if it is true?
