Back in July comedian Tracy Morgan filed a lawsuit against Walmart for negligence after the limo bus he was riding in was rear ended by an 18-wheel Walmart truck on the New Jersey turnpike in a fatal accident that took the life of Tracy's longtime writing partner, James 'Jimmy Mack' McNair, and critically injured Tracy and six other passengers in the vehicle [click here if you missed that].

In their response to Tracy Morgan's lawsuit Walmart blames Tracy the other passengers in the vehicle for not wearing safety belts, claiming their injuries were caused "in whole or in part" by their "failure to properly wear an appropriate available seatbelt restraint device."
Walmart driver Kevin Roper, who had been awake for 24 consecutive hours before the crash, has pleaded not guilty to death by auto and assault by auto.
