Rick's baby mama, Lastonia Leviston, claims after the sex tape went viral she suffered from anxiety, became depressed and suicidal.
On Thursday a New York judge dismissed 50 Cent's motion to have the lawsuit thrown out on the grounds that Lastonia was exaggerating her distress and the case is moving forward.
Lastonia is seeking unspecified damages.
50 Cent purchased the sex tape from Lastonia's ex-boyfriend Maurice Murray who is also featured in the video.
